TERMS OF SERVICE

§ 1 Scope of Application, Customer Information
The following General Terms and Conditions govern the contractual relationship between Frank Schaller CNC-Technik and Companies or private individuals purchasing goods through our shop. We do not recognize any terms and conditions that conflict with or deviate from our own. The language of the contract is German.

§ 2 Vertragsschluss
(1) Die Angebote im Internet stellen eine unverbindliche Aufforderung an Sie dar, Waren zu kaufen.
(2) Sie können ein oder mehrere Produkte in den Warenkorb legen. Im Laufe des Bestellprozesses geben Sie Ihre Daten und Wünsche bzgl. Zahlungsart, Liefermodalitäten etc. ein. Erst mit dem Anklicken des Bestellbuttons geben Sie ein verbindliches Angebot auf Abschluss eines Kaufvertrags ab. Sie können eine verbindliche Bestellung aber auch telefonisch oder per Telefax abgeben. Die unverzüglich per E-Mail bzw. per Telefax erfolgende Zugangsbestätigung Ihrer Bestellung stellt noch keine Annahme des Kaufangebots dar.
(3) Wir sind berechtigt, Ihr Angebot innerhalb von 2 Werktagen unter Zusendung einer Auftragsbestätigung per E-Mail anzunehmen. Nach fruchtlosem Ablauf der in Satz 1 genannten Frist gilt Ihr Angebot als abgelehnt, d.h. Sie sind nicht länger an Ihr Angebot gebunden. Bei einer telefonischen Bestellung kommt der Kaufvertrag zustande, wenn wir Ihr Angebot sofort annehmen. Wird das Angebot nicht sofort angenommen, dann sind Sie auch nicht mehr daran gebunden.

§ 3 Kundeninformation: Speicherung Ihrer Bestelldaten
Ihre Bestellung mit Einzelheiten zum geschlossenen Vertrag (z.B. Art des Produkts, Preis etc.) wird von uns gespeichert. Die AGB schicken wir Ihnen zu, Sie können die AGB aber auch nach Vertragsschluss jederzeit über unsere Webseite aufrufen.

 Als registrierter Kunde können Sie auf Ihre vergangenen Bestellungen über den Kunden LogIn-Bereich (Mein Konto) zugreifen.

§ 4 Kundeninformation: Korrekturhinweis
Sie können Ihre Eingaben vor Abgabe der Bestellung jederzeit mit der Löschtaste berichtigen. Wir informieren Sie auf dem Weg durch den Bestellprozess über weitere Korrekturmöglichkeiten. Den Bestellprozess können Sie auch jederzeit durch Schließen des Browser-Fensters komplett beenden.

§ 5 Reservation of proprietary rights
The purchase remains our property until full payment.

§ 6 Gesetzliche Mängelhaftungsrechte
(1) Mängelhaftungsrechte
 Für unsere Waren bestehen gesetzliche Mängelhaftungsrechte.
(2) Verjährung
 Ihre Gewährleistungsansprüche wegen Mängel der Ware verjähren in einem Jahr ab Gefahrübergang. Von dieser Regelung ausgenommen sind Schadensersatzansprüche, Ansprüche wegen Mängel, die wir arglistig verschwiegen, und Ansprüche aus einer Garantie, die wir für die Beschaffenheit der Ware übernommen haben. Ebenfalls ausgenommen ist Ihr Rückgriffsanspruch nach § 478 BGB. Für diese ausgenommenen Ansprüche gelten die gesetzlichen Verjährungsfristen.

§ 7 Limitation of Lianility
We exclude liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damages resulting from injury to life, body, or health, guarantees, or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include, in particular, the duty to hand over the item to you and to transfer ownership thereof to you. Furthermore, we are obliged to provide you with the item free from material defects and defects of title.

§ 8 Jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contract is our place of business if you are a merchant.

§ 9 Invoicing
Invoices are issued in paper form and enclosed with the delivered goods. Invoices sent via email in PDF format are available for an additional fee.

§ 10 Exchange
For items that are delivered in exchange, the exchange part must be sent back free of charge within 8 working days. The replacement part must not show any burn marks. The replacement part must not be tampered with (no repair attempts) and must not show any mechanical damage. The replacement part must not have any etched conductor tracks due to leaking electrolytic capacitors or batteries. The replacement part must be complete. Otherwise, the difference between the exchange price and the purchase price will be charged afterwards!

§ 11 Return
For items that are returned, we charge an inspection and restocking fee of 10% of the value of the goods, but at least €80.00 per Part. We would also like to point out that if items are returned without their original product packaging or without suitable packaging (e.g., ESD-compliant) you may be liable to compensate for any resulting loss in value. The item must be returned within 7 days of its receipt by the customer.
The buyer bears the cost of the return shipment.
Software is excluded from return!

§ 12 Deposit (Core Charge)
We reserve the right to demand a deposit equal to the difference between the exchange price and the purchase price for new customers or deliveries abroad. The deposit will be refunded after the old part has been returned and the exchangeability has been checked positively. If the replacement part does not arrive within two weeks of receipt of the delivery to the seller, the refund of the deposit will be reduced by 10% for each week started.

§ 13 Price
The prices for repairs or replacements refer to assemblies that can be restored with normal effort. Damage caused by short circuits in external components, overvoltage, contamination with graphite or additional costs due to customer attempts to repair will be charged at cost.

§ 14 Communication
The spoken and written communication language is German. We do not assume any liability for error-free communication in other languages.

§ 15 Data-Backup
It is the customer's responsibility to save or create a backup of the data, programs and machine parameters. We do not assume any guarantee for the content of the data.

§ 16 Passing of Risk upon Shipment
If the goods are shipped to the purchaser at the latter’s request, the risk of accidental loss or accidental deterioration of the goods passes to the purchaser upon dispatch to the purchaser or, at the latest, upon leaving the factory or warehouse. This applies irrespective of whether the shipment of the goods originates from the place of performance or who bears the freight costs (in the Federal Republic of Germany, this applies exclusively in the B2B sector).

§ 17 Shipping-Insurance
The standard coverage limit for damage during transport or loss is €500.00. It is possible to increase this coverage limit with UPS for an additional fee. The cost for this is 1% of the value of the goods for domestic shipping and 1.5% of the value of the goods for international shipping; coverage can be added in increments of €100.00. Furthermore, UPS’s General Terms and Conditions apply.

§ 18 Damage during transit
As the recipient, you are obliged to check the external integrity of the shipment upon receipt. If the shipment is clearly damaged externally (box torn, dents, water damage, etc.), refuse to accept the shipment. Damage during transit is not handled by us, but by our responsible carrier. In the event of any transit damage discovered after acceptance, please contact the relevant carrier immediately.

Our logistics partners UPS and DPD ask for these points to be followed:

UPS: Report concealed damage to the supplier in writing (via email) within 3 calendar days. Retain all packaging materials. UPS will collect these materials, along with the damaged item, to inspect them for causality.

DPD: Transit damage for already accepted packages must be documented by the recipient in a photograph and reported within 24 hours via email to service@dpd.de

It is not possible to send defective packages to us and, if you do so, it will not be accepted as transit damage by UPS or DPD. Therefore, in your own interest, we would urge you to follow the procedure as described.

§ 19 Offers
The offer remains valid for four weeks, unless otherwise agreed. For items procured, manufactured, or produced specifically at the customer's request, the offer remains valid for one week beyond the earliest possible delivery date.

§ 20 KVA (Repair-Cost-Estimate)
In the course of checking your defective assembly to see if it can be repaired, it will be disassembled and components will be unsoldered if necessary. If you do not place an order, the defective assembly will be returned disassembled!

§ 21 Working-conditions
The machine and the control cabinet must be freely accessible for on-site service calls. The area around the machine and the control cabinet must be free of chips and other operating materials. Adequate lighting must be provided at and around the machine.
